Information We Collect:

HighJinks collects non-personally identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. HighJinks’s purpose in collecting non-personally identifying information is to better understand how HighJinks visitors use its website. From time to time, HighJinks may release non-personally identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

HighJinks primarily collects real estate transaction related personal identifying information. This includes personal information you knowingly choose to disclose that is collected by us; transactional information collected by us as you interact with our services; usage information that is collected by our servers as you use our applications; and information related to third party services that you would like to access through our applications and services. By accepting the Privacy Policy and the User Agreement in registration, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the terms of the HighJinks Terms of Use Agreement. This Privacy Policy is effective upon acceptance in registration for new registering users.

Our primary purpose in collecting personal information is to provide you with a safe, secure online application which will assist you in sending and signing documents, communicating, and streamlining the real estate transaction to achieve a smooth and efficient closing. In order to do so, HighJinks must collect information to identify users, and to allow our users to identify each other. We only collect information about you that we consider necessary for achieving this purpose.

Certain visitors to HighJinks’s website choose to interact with HighJinks in ways that require HighJinks to gather personally identifying information. The amount and type of information that HighJinks gathers depends on the nature of the interaction. For example, we ask visitors who sign up for an account on http://HighJinks.com to provide a username and email address. In each case, HighJinks collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with HighJinks. HighJinks does not disclose personally identifying information other than as described below. And Users must supply personally identifying information, with the caveat, that failure to do so may prevent them from engaging in certain website related services.

Use of Information Obtained by HighJinks

When you register with HighJinks, you provide us with certain personal information, such as your name, username, your email address and any other personal or preference information that you provide to us. When you launch or interact with a HighJinks application, we collect your device type and IP address. This information is gathered for all users. In addition, we use the unique Device ID (“UUID”) that vendors such as Apple and Android licensees makes available for each device in order to authenticate the user session. This UUID functions similarly to a persistent cookie to make it possible to authenticate the user without the need for a password.

When you register with HighJinks, you create your own profile. Your name, username and email address are displayed to other HighJinks users to enable you to connect with people on HighJinks. We expect that you will use the name which you are most commonly known by and reflected in the transactional documents. We may occasionally use your username or email address to send you notifications regarding new services offered by HighJinks that we think you may find valuable. Your profile can be shared across all of the applications in the HighJinks portfolio. As a previously registered user, when you download and access a new HighJinks application, your user profile is automatically incorporated into that new application.

When you use HighJinks applications, you may set up your personal profile, form transactional based roles for yourself and other transactional parties, send messages, and transmit information through various channels. We collect this information so that we can provide you the service and offer personalized features. In most cases, we retain it so that, for instance, you can return to view prior documents or messages you have posted or easily see the list of transactional parties. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.

HighJinks may send you service-related announcements from time to time through the general operation of the service. For instance, if another User posts a new amendment, you may receive an email or other notification alerting you to that fact. These announcements may also relate to new product launches or other relevant information about HighJinks and the services we provide. HighJinks may use information in your profile or related to your activities on HighJinks applications in order to personalize the application experience for you and other transactional users. HighJinks may also share information such as user trends, application download, and transactional information in aggregate to third parties by identifying you as an individual with relation to all information that would readily be available through public records upon the close of any transaction.

Any and all User Content that you provide through HighJinks services is at your own risk. We cannot control the actions of other Users with whom you may choose to share your information. Therefore, we cannot and do not guarantee that User Content you post with HighJinks will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained in HighJinks services. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived form or if other Users have copied or stored your User Content. Any improper collection or misuse of information provided on HighJinks applications is a violation of the HighJinks Terms of Service and should be reported to info@HighJinks.com.

If you choose to use our invitation service, we may ask you for information needed to send the invitation, such as the recipient’s email address and we will automatically send a one-time email or instant message inviting him or her to visit the site or to download our services. HighJinks stores this information to send this one-time invitation, to register a new connection if your invitation is accepted, and to track the success of our referral program. The person you invited may contact us at info@HighJinks.com to request that we remove this information from our databases. In order to facilitate interaction among all HighJinks members, our Services may allow you limited access to other users’ contact and authentication status information. By entering into our Terms of Service, you agree that, with respect to other users’ information that you obtain through the Site or through a HighJinks- related communication or HighJinks facilitated transaction, HighJinks hereby grants to you a license to use such information only for: (a) HighJinks- related communications that are not unsolicited commercial messages, (b) using services offered through HighJinks (e.g. document sending, signing, messaging etc.) for transactional purposes, and (c) any other purpose that a user expressly agrees to after you tell them the purpose you would like to use it.

In addition, under no circumstances, except as defined in this Section, can you disclose personal information about another user to any third party without our consent and the consent of that user. You agree that other users may use your personal information to communicate with you in accordance with this Section. HighJinks may also collect information about you from other sources, such as, blogs, messaging services, and other users of HighJinks applications through the operation of the service in order to provide you with more useful information and a more personalized experience by using HighJinks, you are consenting to have your personal data transferred to and processed in the United States.

Third Party Services Accessed by HighJinks

You can configure certain third party services to be accessed by HighJinks services. When you do so, we will store your access credentials to such third party services in a secure manner; we may temporarily cache your list of contacts from these services; and we will store messages, videos, and other content created using our services that are delivered to such third party services. We do this to improve the performance and experience of these services (such as, adding videos and location information not available in the third party services).

Sharing Your Information with Third Parties

HighJinks is about users sharing information with others. We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is 1) necessary for business operations (e.g., emailing you through a third party server), 2) legally required or when we choose to collaborate with a law enforcement agency in the investigation of a possible crime, 3) permitted by you. If the ownership of HighJinks were to change, your user information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your user information would remain subject to the promises made in any pre-existing Privacy Policy.

Changing or Removing Information

HighJinks users may modify or delete any of their profile information at any time by logging into their account. Information will be updated immediately. Individuals who wish to deactivate their HighJinks account may do so by emailing us at info@HighJinks.com. Removed information may persist in backup copies for a reasonable period of time but will not be generally available to members of HighJinks. HighJinks services and applications have communication features that allow you to share information with other individuals on HighJinks, however, you generally cannot remove such communications.

Security

HighJinks takes appropriate precautions to protect our users’ information. Your account information is located on a secured server or hosted by a third party cloud service provider such as Amazon. HighJinks does not run and cannot guarantee the security of third party cloud service providers. Children

HighJinks does not knowingly collect or retain personal information about persons under 18 years of age. Any person who provides their personal information to HighJinks through its Services must be 18 years of age or older. If we learn that personal information of persons under the age of 18 years has been collected on one of our Services we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 18 has obtained a Service account, then you may alert us at info@HighJinks.com and request that we delete that child’s personal information from our systems.

International Users

HighJinks abides by the safe harbor framework set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information collected from the European Union. The following link provides more information about the U.S. Department of Commerce Safe Harbor Program. Our services are located in the United States. If you are located in one of the 15 European Union Member Nation States (Austria, Belgium, Denmark, Finland, France, Germany, Greece, Ireland, Italy, Luxembourg, Netherlands, Portugal, Spain, Sweden, and the United Kingdom), Canada or any other nation with privacy legislation you should be aware that personal information submitted to HighJinks will be transferred to a data center in the United States. If you post information to the HighJinks sites, you are confirming your consent to such information, including personal data and content, being hosted and accessed in the United States.

Your use of HighJinks, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Use and all of its dispute resolution provisions including arbitration, limitation on damages and choice of law. We reserve the right to change our Privacy Policy and our Terms of Use at any time. Nonmaterial changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on this site. If we make changes, we will post them and will indicate at the top of this page the policy’s new effective date. We encourage you to refer to this policy on an ongoing basis so that you understand our current privacy policy. Unless stated otherwise, our current privacy policy applies to all information that we have about you and your account.

Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies.
